Supreme Court on Friday said it will hear on Monday, the petitions filed by former Parliamentarian, seeking a direction to construct and allow people to worship in the Ravidas temple in Tughlakabad area in Delhi.
Ashok Tanwar, former MP and former President of Haryana State Congress and Pradeep Jain, a former Union Minister and Member of Parliament are petitioners in the case.
Appearing for the Petitioners, Senior advocate and noted legal expert, Vikas Singh submitted that the Ravidas Temple at Tughlaqabad, Delhi was unfortunately demolished on August 10, 2019.
"We will hear the matter on September 16, Monday," the Apex Court bench Friday said, after hearing the submissions from Singh.
Nevertheless, the petitioners have right to worship at the site, as it is divine in nature because Saint Guru Ravidas himself had lived there, Singh said to the Apex Court bench, headed by Justice R Banumathi.
He added that Legislative Assembly of Delhi has passed a resolution recognizing the historical and religious importance of the site.
There are crores of Ravidas followers, and they all are affected by the demolition of the temple.
The Bench asked the question and wanted to know from the petitioners, as to how the Temple was demolished.
Senior advocate, Singh submitted that a Civil Suit in 1992 was filed by an encroacher claiming property rights over the temple.
The encroacher lost his case in the Supreme Court. The DDA as per the Supreme Court order passed by the Bench of Justice Arun Mishra, took the possession of the site, and demolished the Temple.
However, the present case was different as the Civil Suit filed in 1992 was not a representative suit, i.e. not filed on behalf of Ravidas community and hence cannot bind the petitioners.
