Court rejects Kuldeep Sengar's bid to pause sentence in custodial death case

The Delhi High Court on Monday rejected a plea by Unnao rape convict and former BJP MLA Kuldeep Singh Sengar to suspend his 10-year sentence in the custodial death of the survivor’s father.
The rejection came weeks after the Supreme Court paused the Delhi High Court’s order suspending the former MLA's life sentence in the 2017 rape case.
Reading out the court's decision today, Justice Ravinder Dudeja said Sengar’s plea challenging his conviction will be heard in due course.
Sengar's plea sought suspension of the sentence pending appeal against his 2019 trial court conviction. He cited prolonged incarceration and deteriorating health, including diabetes, cataracts, and retinal detachment, as grounds, requesting medical treatment at AIIMS outside Tihar Jail.
Both the Central Bureau of Investigation (CBI) and the survivor opposed the plea, highlighting the gravity of the offences, which included abduction and assault that led to custodial death.
The CBI further argued that Sengar played a role in attempting to silence the family.
On March 13, 2020, a trial court sentenced Sengar to 10 years of rigorous imprisonment and imposed a fine of Rs 10 lakh in connection with the custodial death of the Unnao rape survivor’s father. The court emphasised that “no leniency” could be shown for the killing of a family’s “sole breadwinner.”
Both the Central Bureau of Investigation (CBI) and the survivor opposed the plea, highlighting the gravity of the offences, which included abduction and assault that led to custodial death.
The CBI further argued that Sengar played a role in attempting to silence the family.
